1. Purpose of This Policy
Commailer provides services related to business email infrastructure, mail server setup assistance, email configuration, email campaign management, and email deliverability guidance.
This Acceptable Use & Anti-Spam Policy explains the rules customers must follow when using our services. Its purpose is to promote lawful, secure, transparent, and responsible email practices.
By purchasing or using our services, you agree to comply with this policy and all applicable laws, regulations, and third-party platform requirements.
2. Lawful and Responsible Email Use
Customers must use Commailer services only for legitimate business communication and other lawful purposes.
You are responsible for ensuring that your email activities comply with applicable laws and regulations, including anti-spam, privacy, data protection, consumer protection, and electronic communications requirements.
Depending on your location, recipients, and type of campaign, relevant requirements may include the CAN-SPAM Act in the United States, the GDPR and applicable electronic marketing laws in the European Economic Area, and other applicable national or regional regulations.
Commailer does not provide legal advice. Customers are responsible for obtaining appropriate legal guidance when necessary.
3. Permission-Based Email Marketing
Customers must ensure they have a valid legal basis and any required permission or consent before sending marketing emails.
You must not use our services to send unsolicited or unlawful bulk email. You must not use purchased, rented, harvested, scraped, or otherwise improperly obtained email lists where their use violates applicable law, consent requirements, or the rules of the relevant email platform.
You are responsible for maintaining appropriate records of consent or other lawful grounds for contacting recipients when required.
4. Prohibited Activities
You must not use Commailer services, directly or indirectly, for any of the following activities:
Sending spam, deceptive bulk email, or other unlawful unsolicited messages.
Conducting phishing, impersonation, identity theft, or credential-harvesting campaigns.
Sending fraudulent messages, scams, malicious links, or deceptive attachments.
Distributing malware, ransomware, viruses, or other harmful software.
Forging email headers, falsifying sender identities, or misleading recipients about the source of a message.
Operating deceptive domains or using lookalike domains to impersonate another person, business, or organization.
Bypassing spam filters, security controls, sending restrictions, or account enforcement measures.
Using compromised accounts, unauthorized servers, or email addresses without permission.
Sending unlawful, threatening, harassing, discriminatory, or otherwise prohibited content.
Collecting, sharing, or processing personal information without an appropriate legal basis or authorization.
Continuing to send marketing messages to recipients who have opted out or whose consent is no longer valid where consent is required.
Engaging in activities that violate applicable law or the terms of third-party email, hosting, or infrastructure providers.
This list is not exhaustive. Commailer may review other activities that pose legal, security, or abuse risks.
5. Recipient Consent and Unsubscribe Requirements
Customers who send marketing emails must provide recipients with clear and appropriate information about the sender and the purpose of the communication.
Where required by law, marketing emails must include a functioning unsubscribe mechanism and a valid way to contact the sender.
Customers must honor unsubscribe requests within the time required by applicable law and must maintain suppression lists or equivalent controls to avoid contacting individuals who have opted out.
Unsubscribe mechanisms must not require unnecessary personal information or unreasonable steps.
6. Sender Identity and Email Authentication
Customers are responsible for providing accurate sender information and maintaining appropriate authorization for the domains and email accounts they use.
Where applicable, email authentication measures such as SPF, DKIM, and DMARC should be configured appropriately to help protect domain integrity and reduce unauthorized use.
Customers must not use authentication settings, sender names, domain configurations, or routing methods to misrepresent their identity or conceal unlawful activity.
Configuration assistance does not guarantee acceptance by recipient mail servers or placement in inboxes.
7. Email Lists and Data Protection
Customers are responsible for ensuring that the email addresses and other personal information they provide or use were collected and are processed lawfully.
You must take reasonable steps to protect recipient information, restrict access to authorized personnel, and retain personal data only as long as necessary for legitimate purposes or as required by law.
You must not provide Commailer with personal information you are not authorized to share. If you suspect that a list or account contains improperly obtained information, do not upload or use it through our services.
For additional details about our handling of personal information, please review our Privacy Policy and any applicable Data Protection Policy.
8. Account Security and Authorized Access
Customers must maintain the security of their email accounts, domains, hosting environments, and related services.
You must:
Use strong, unique passwords and multifactor authentication where available.
Grant access only to authorized individuals.
Keep software, systems, and security settings appropriately maintained.
Notify the relevant provider promptly if you suspect unauthorized access.
Avoid sending passwords, private keys, recovery codes, or other sensitive credentials through unsecured channels.
Ensure that any access granted to Commailer is authorized, limited to the work required, and revoked when no longer needed.
Customers must not attempt to gain unauthorized access to systems, accounts, or data belonging to Commailer or another party.
9. Sending Limits and Third-Party Services
Email platforms, hosting providers, domain registrars, and mail server operators may impose their own sending limits, acceptable-use rules, verification requirements, and security restrictions.
Customers must comply with the rules of each third-party provider involved in their email operations.
Commailer does not authorize customers to exceed provider limits, evade enforcement measures, or use infrastructure for prohibited bulk sending.
Third-party fees, account approvals, service availability, and provider decisions are controlled by the relevant providers and may change independently of Commailer.
10. Deliverability and Reputation
Commailer may provide guidance on email authentication, sending configuration, list hygiene, campaign practices, and deliverability-related issues.
However, email delivery and inbox placement depend on many factors outside our control, including recipient-server decisions, sender reputation, message content, recipient engagement, authentication, and third-party filtering systems.
We do not guarantee that messages will reach recipients' inboxes, avoid spam folders, achieve a particular delivery rate, or generate specific business results.
Customers are responsible for monitoring their sending practices and responding appropriately to delivery failures, complaints, and reputation concerns.
11. Reporting Abuse
If you believe that Commailer services are being used for spam, phishing, fraud, unauthorized sending, or another prohibited activity, please contact us at:
Email: support@commailer.store
When possible, include relevant details such as the sender domain, date, message information, and a description of the concern. Do not send unnecessary sensitive personal information or passwords.
We will review reports as appropriate and may request additional information to investigate the issue.
12. Monitoring and Enforcement
Where reasonably necessary and permitted by law, Commailer may investigate credible reports of misuse, security incidents, or violations of this policy.
Depending on the circumstances, we may:
Request information or corrective action from the customer.
Suspend campaign work or restrict access to affected services.
Decline to configure or support an unlawful or abusive sending activity.
Suspend or terminate services in accordance with the applicable agreement.
Preserve relevant records or report suspected unlawful conduct to appropriate parties where legally required or permitted.
We aim to respond proportionately to the circumstances. Enforcement actions may be taken without advance notice where necessary to address urgent security, legal, or abuse risks.
13. Customer Responsibility
Customers remain responsible for the content of their emails, the accuracy of sender information, the legality of their recipient lists, required consent, campaign instructions, and compliance with applicable laws.
Commailer may provide technical or operational assistance, but such assistance does not transfer the customer's legal responsibilities to Commailer.
Customers must indemnify or compensate Commailer only to the extent provided in an applicable agreement and permitted by law; nothing in this policy excludes rights or liabilities that cannot legally be excluded.
14. Policy Violations
Violations of this policy may result in refusal of service, suspension, termination, or other reasonable action under the applicable service terms.
Refund eligibility following suspension or termination is governed by our published Refund & Cancellation Policy, the relevant service agreement, and applicable law.
15. Changes to This Policy
Commailer may update this policy to reflect changes in our services, security practices, legal requirements, or third-party platform rules.
The updated policy will be published on this page with a revised effective date. Continued use of our services after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
